1. Bu bölümde " pellet " tabirinden, doğrudan doğruya sıkıştırma suretiyle veya ağırlığının % 3' ünü geçmeyecek oranda bir bağlayıcı ilavesiyle küçük topaklar halinde bir araya getirilen ürünler anlaşılır.
SEBZELER, MEYVELER, SERT KABUKLU MEYVELER VE BİTKİLERİN DİĞER KISIMLARINDAN ELDE EDİLEN MÜSTAHZARLAR
1. Aşağıda yazılı olanlar bu fasıla dahil değildir: (a) 7., 8. veya 11. fasıllarda belirtilen usullerle hazırlanmış ve konserve edilmiş sebze, meyveler ve sert kabuklu meyveler; (b) Bitkisel katı ve sıvı yağlar (Fasıl 15) (c) Ağırlık itibariyle % 20'den fazla sosis, et, sakatat, kan, böcek, balık veya kabuklu hayvanlar, yumuşakçalar veya diğer su omurgasızları veya bunların herhangi bir karışımını içeren gıda müstahzarları (Fasıl 16); (d) 19.05 pozisyonunda yer alan ekmekçi mamulleri ve diğer ürünler; veya (e) 21.04 pozisyonunda yeralan homojenize edilmiş bileşik gıda müstahzarları. 2. Şeker mamulleri (17.04 pozisyonu) veya çikolata mamulleri (18.06 pozisyonu) haline getirilmiş meyve jöleleri, meyve ezmeleri, bademli şekerler veya benzerleri 20.07 ve 20.08 pozisyonlarına dahil değildir. 3. Yukarıda 1 (a) notunda belirtilen usullerden başka bir şekilde hazırlanmış veya konserve edilmiş, sadece 7. fasıldaki ürünler veya 11.05 veya 11.06 (8. fasıldaki ürünlerin unları, kaba unları ve tozları hariç) pozisyonlarında yer alan ürünler, duruma göre, 20.01, 20.04 ve 20.05 pozisyonlarında yeralırlar. 4. Kuru ağırlık muhteviyatı % 7 veya daha fazla olan domates suları 20.02 pozisyonunda yer alır. 5. 20.07 pozisyonu anlamında, " pişirilerek elde edilmiş " tabirinden, su içeriğinin azaltılması yoluyla veya diğer yöntemlerle bir ürünün viskozitesinin arttırılması için, atmosfer basıncında veya düşürülmüş basınç altında ısıl işleme tabi tutularak elde edilmesi anlaşılır. 6. 20.09 pozisyonu tatbikinde, "fermente edilmemiş ve ilave alkol katılmamış sular" tabirinden hacim itibariyle (22. Fasılın 2 nolu Notuna bakınız) alkol derecesi %0.5'i geçmeyen sular anlaşılır.
SEBZELER, MEYVELER, SERT KABUKLU MEYVELER VE BİTKİLERİN DİĞER KISIMLARINDAN ELDE EDİLEN MÜSTAHZARLAR
1. 2005.10 alt pozisyonunun tatbikinde " homojenize sebzeler " tabirinden, iyice homojenize edilmiş, bebek veya küçük çocuk maması veya perhiz yemeği olarak net ağırlığı 250 gr.ı geçmeyen kaplar içinde perakende satış için hazırlanmış sebze müstahzarları anlaşılır. Bu tanımın uygulanmasında, müstahzara lezzet vermek, bozulmasını önlemek veya diğer amaçlarla az miktarda ilave edilen unsurlar dikkate alınmaz. Bu müstahzarlar görülebilecek kadar küçük sebze parçaları içerebilirler. 20.05 pozisyonunun tüm alt pozisyonları arasında 2005.10 alt pozisyonu öncelikle dikkate alınır. 2. 2007.10 alt pozisyonunun tatbikinde " homojenize müstahzarlar " tabirinden, iyice homojenize edilmiş, bebek ve küçük çocuk maması veya perhiz yemeği olarak net ağırlığı 250 gr.ı geçmeyen kaplar içinde perakende satış için hazırlanmış meyve müstahzarları anlaşılır. 1. 20.01 pozisyonunun uygulanmasında, sirke veya asetik asitle hazırlanmış veya konserve edilmiş sebze, meyve, sert kabuklu meyve ve bitkilerin yenilen diğer kısımlarının, asetik asit olarak ifade edilen serbest, uçucu asit içeriği, ağırlık itibariyle %0,5 veya daha fazla olmalıdır. Ayrıca, 2001.90.50 alt pozisyonunda yeralan mantarların tuz içeriği, ağırlık itibariyle %2,5'i aşmamalıdır. 2. (a) Bu fasılda sınıflandırılan ürünlerin sakkaroz (şeker içeriği) olarak ifade edilen çeşitli şeker içeriği 20 ºC sıcaklıkta refraktometre tarafından gösterilen: - 2008.20 ila 2008.80, 2008.93, 2008.97 ve 2008.99 alt pozisyonlarında yeralan ürünlerle ilgili olarak 0,93 veya - Diğer pozisyonlarda yeralan ürünlerle ilgili olarak 0,95 faktörüyle çarpılmış olan rakama tekabül eder. (b) 20.09 pozisyonunun alt pozisyonlarında sözü edilen " Brix değeri " tabiri, 20 ºC sıcaklıkta refraktometre tarafından gösterilen rakama tekabül eder. 3. 2008.20 ila 2008.80, 2008.93, 2008.97 ve 2008.99 alt pozisyonlarındaki ürünler, şeker oranları, meyvelerin cinsi veya bitkilerin yenilen kısımlarına göre ağırlık itibariyle aşağıda belirtilen oranları geçtiği taktirde " ilave şeker içeren " olarak kabul edilecektir: - Ananas ve üzümler için % 13; - Diğer meyveler (meyve karışımları dahil) ve bitkilerin yenilen diğer kısımları için % 9. 4. 2008.30.11.00 ila 2008.30.39.00, 2008.40.11.00 ila 2008.40.39.00, 2008.50.11.00 ila 2008.50.59.00, 2008.60.11.00 ila 2008.60.39.00, 2008.70.11.00 ila 2008.70.59.00, 2008.80.11.00 ila 2008.80.39.00, 2008.93.11.00 ila 2008.93.29.00, 2008.97.12.00 ila 2008.97.38.00 ve 2008.99.11.00 ila 2008.99.40.00 alt pozisyonlarının uygulanmasında; - " Kazanılmış alkolometrik kütle hacmi " (alkol derecesi) tabirinden, ürünün 100 kg.da bulunan saf alkolün kg. sayısı, - % mas: " kütlesel hacmi " tabirinden " alkolometrik kitle hacmi " anlaşılır. 5. Aşağıdakiler, eşyalara sunuldukları hallerde uygulanır. (a) 20.09 pozisyonundaki ürünlerin ilave şeker oranı, meyve suyunun cinsine göre, " şeker muhteviyatından " aşağıda belirtilen rakamların çıkarılması suretiyle tespit edilir: - Limon veya domates suyu için: 3; - Üzüm suyu için: 15; - Diğer meyve ve sebze suları için (karışımlar dahil): 13. (b) Brix değeri 67’yi geçmeyen ve ağırlık itibariyle %50’den daha az meyve suyu ihtiva eden şeker ilave edilmiş meyve suları 20.09 pozisyonunda yer alan meyve sularının orijinal karakterini kaybederler. (b) bendi konsantre edilmiş tabii meyve sularına uygulanmaz.
